Informativa sulla privacy

Questa informativa spiega come SIMCA S.R.L. tratta i dati personali di chi visita il sito e di chi contatta SIMCA tramite il sito o ai recapiti indicati sul sito. Le informazioni sono fornite in base all'art. 13 del Regolamento (UE) 2016/679 (GDPR) e al D.Lgs. 30 giugno 2003, n. 196 (Codice in materia di protezione dei dati personali), come modificato dal D.Lgs. 10 agosto 2018, n. 101 (il «Codice»).

L'informativa vale per il sito www.simca-srl.com, anche quando vi si accede dall'indirizzo simca-srl.com. Non riguarda i siti di terzi raggiungibili tramite link.

Con «utente» si intende la persona fisica a cui si riferiscono i dati: chi visita il sito, chi compila un modulo o chi contatta SIMCA. Il sito si rivolge principalmente a imprese e professionisti. Anche i dati dei referenti aziendali (ad esempio nome, e-mail di lavoro e telefono) sono dati personali e sono trattati come descritto di seguito.

L'informativa è disponibile in italiano e in inglese e le due versioni hanno lo stesso contenuto. In caso di differenze dovute alla traduzione prevale la versione italiana; per qualsiasi dubbio, l'utente può scrivere a info@simca-srl.com.

Dati di navigazione

Il sito è realizzato e ospitato sulla piattaforma Webflow. Per mostrare le pagine, i sistemi di Webflow e dei suoi fornitori di infrastruttura (Amazon Web Services e Cloudflare) ricevono e registrano automaticamente i dati tecnici che il browser trasmette a ogni visita, tra cui:

  • indirizzo IP del dispositivo
  • data e ora della richiesta
  • pagina o file richiesto
  • tipo di browser e sistema operativo (user agent)
  • lingua del browser e altre informazioni contenute nelle intestazioni HTTP della richiesta

Durante la navigazione le pagine caricano file (immagini, fogli di stile, script e caratteri tipografici) solo dai server di Webflow e dei suoi fornitori: cdn.prod.website-files.com, s3.amazonaws.com (Amazon S3) e d3e54v103j8qbb.cloudfront.net (Amazon CloudFront). Il sito non carica contenuti da altri servizi: non contiene mappe, video incorporati, pulsanti dei social network, pixel pubblicitari o strumenti di analisi statistica. I collegamenti che avvengono all'invio dei moduli sono descritti nelle sezioni dedicate.

Per conto di SIMCA questi dati sono trattati solo per far funzionare il sito e proteggerlo da attacchi e abusi, e non sono usati per identificare o profilare l'utente. SIMCA non ha accesso diretto a questi registri. Solo in caso di attacco o reato informatico ai danni del sito, SIMCA può chiederli a Webflow per accertare le responsabilità o per consegnarli alle autorità competenti che li richiedano.

Webflow utilizza i dati tecnici dei visitatori dei siti che ospita anche per finalità proprie, come indicato nella sua informativa sulla privacy: misurare il volume di traffico dei siti (anche ai fini della fatturazione), proteggere la propria piattaforma, svolgere analisi statistiche e sviluppare prodotti di analisi basati su dati de-identificati. Per questi trattamenti Webflow agisce come titolare autonomo.

Cookie e tecnologie simili

I cookie sono piccoli file di testo che un sito salva nel browser dell'utente. In questa informativa sono considerati tecnici i cookie e gli strumenti simili usati solo per trasmettere una comunicazione o strettamente necessari a fornire un servizio richiesto dall'utente (art. 122, comma 1, del Codice). Gli altri cookie, come quelli di statistica, di profilazione o pubblicitari, richiedono in generale il consenso dell'utente.

Durante la navigazione il sito imposta un solo cookie, di tipo tecnico: _cfuvid. Lo imposta Cloudflare, il fornitore di Webflow per la distribuzione e la protezione del sito, su www.simca-srl.com e sugli indirizzi che rimandano al sito. Serve a distinguere i singoli visitatori che condividono lo stesso indirizzo IP, così che i sistemi di sicurezza possano limitare le richieste anomale senza bloccare gli altri utenti. È un cookie di sessione: viene cancellato alla chiusura del browser. Gli script delle pagine non possono leggerlo e non è usato per tracciare l'utente. Maggiori informazioni nella documentazione di Cloudflare.

SIMCA non utilizza cookie di statistica, di profilazione o pubblicitari, né propri né di terze parti, né altre tecniche di tracciamento come il fingerprinting. Durante la navigazione il sito non salva dati nella memoria locale del browser (localStorage o sessionStorage).

Poiché durante la navigazione è presente solo un cookie tecnico, il sito non chiede il consenso e non mostra un banner dei cookie, come consentito dalle Linee guida del Garante sui cookie e altri strumenti di tracciamento del 10 giugno 2021.

Servizi di terze parti contattati all'invio dei moduli. Quando l'utente invia il modulo di richiesta di preventivo, il browser invia i dati direttamente ai server di Mailchimp (simca-srl.us22.list-manage.com). In questa occasione Mailchimp e Akamai, il suo fornitore di sicurezza, possono impostare questi cookie di terza parte:

  • _abck (Akamai): serve a riconoscere e bloccare il traffico automatizzato. Durata: 1 anno.
  • bm_sz (Akamai): serve a riconoscere e bloccare il traffico automatizzato. Durata: circa 4 ore.
  • _mcid (Mailchimp): identificativo impostato da Mailchimp, di cui Mailchimp non pubblica la finalità. SIMCA non lo utilizza. Durata: 1 anno.

Se e quali di questi cookie vengono salvati dipende dal browser: molti browser bloccano i cookie di terza parte in modo predefinito. Quando l'utente invia il modulo newsletter, il browser invia i dati ai server di Webflow (webflow.com). SIMCA non legge e non utilizza i cookie di questi servizi. Maggiori informazioni: informativa sui cookie di Mailchimp e informativa sui cookie di Webflow.

Gestione dal browser. L'utente può cancellare i cookie e bloccarne l'installazione dalle impostazioni del proprio browser.

Preferenze cookie. Dal link «Cookie Settings» in fondo a ogni pagina l'utente può consultare in qualsiasi momento le categorie di cookie utilizzate dal sito. Oggi sono presenti solo cookie tecnici, che non richiedono consenso. Se in futuro saranno aggiunti cookie facoltativi, dallo stesso link l'utente potrà prestare, negare o revocare il consenso; la scelta sarà salvata per 6 mesi in un cookie tecnico (simca_consent) e, fino al consenso, i servizi facoltativi resteranno bloccati.

Prima di aggiungere al sito strumenti non tecnici, come statistiche di visita, mappe o video incorporati, SIMCA aggiornerà questa informativa e chiederà il consenso dell'utente con un banner.

Iscrizione alla newsletter

In fondo a ogni pagina è presente il modulo «Subscribe to newsletter», che richiede soltanto l'indirizzo e-mail. Il modulo è gestito da Webflow. Quando l'utente lo invia, il browser trasmette ai server di Webflow l'indirizzo e-mail insieme a questi dati tecnici: indirizzo IP, tipo di browser, pagina da cui è stato inviato il modulo, data e ora. Webflow registra l'iscrizione nell'archivio dei moduli del sito, a cui accede SIMCA, e invia una notifica con i dati del modulo a una casella e-mail di SIMCA.

SIMCA utilizza l'indirizzo esclusivamente per inviare la propria newsletter, con aggiornamenti su prodotti, servizi, novità e iniziative dell'azienda. Per gestire la lista degli iscritti e inviare la newsletter, SIMCA può inserire l'indirizzo nella propria lista contatti su Mailchimp (vedi «Destinatari dei dati»).

L'iscrizione si basa sul consenso dell'utente, espresso inviando il modulo dopo aver letto la nota sotto il campo e-mail, che indica lo scopo dell'iscrizione e rimanda a questa informativa. L'utente può annullare l'iscrizione in qualsiasi momento con il link presente in fondo a ogni e-mail o scrivendo a info@simca-srl.com.

Le e-mail della newsletter possono rilevare aperture e clic, come spiegato nella sezione «Misurazione di aperture e clic nelle e-mail». Basi giuridiche e tempi di conservazione sono indicati nelle sezioni «Finalità e basi giuridiche» e «Periodi di conservazione».

Richiesta di preventivo

Nella pagina dedicata ai sistemi di riciclo dell'acqua SIMCA STARLIGHT (www.simca-srl.com/green) è presente il modulo «Richiedi il test gratuito», con cui l'utente può chiedere il test gratuito di STARLIGHT o un preventivo (in questa informativa, per brevità, «richiesta di preventivo»). Il modulo raccoglie i seguenti dati:

  • Nome (obbligatorio)
  • Cognome (obbligatorio)
  • Azienda, cioè la ragione sociale (obbligatorio)
  • E-mail (obbligatorio)
  • Telefono (facoltativo)

Il modulo contiene inoltre due caselle di spunta:

  • «Ho letto l'informativa privacy» (obbligatoria): conferma soltanto che l'utente ha potuto leggere questa informativa. Non è un consenso e non viene trasmessa a Mailchimp.
  • «Acconsento a ricevere via email comunicazioni commerciali e aggiornamenti da SIMCA» (facoltativa e non selezionata in partenza): è il consenso a ricevere comunicazioni commerciali e aggiornamenti via e-mail. Se l'utente non la seleziona, SIMCA risponde comunque alla richiesta di preventivo.

SIMCA utilizza questi dati per rispondere alla richiesta di preventivo e, solo se l'utente ha selezionato la casella facoltativa, per inviargli comunicazioni commerciali e aggiornamenti via e-mail.

Il modulo è collegato a Mailchimp, la piattaforma che SIMCA usa per organizzare i contatti e inviare e-mail. Quando l'utente invia il modulo, il browser trasmette i dati direttamente ai server di Mailchimp (simca-srl.us22.list-manage.com), senza passare da Webflow. Insieme ai dati del modulo, Mailchimp registra nella lista contatti di SIMCA:

  • la scelta espressa sulla casella del consenso commerciale
  • un'etichetta interna (tag), uguale per tutte le richieste inviate con questo modulo
  • i dati tecnici dell'invio: indirizzo IP, data e ora

Dall'indirizzo IP, Mailchimp ricava una localizzazione approssimativa (paese, regione, fuso orario e coordinate approssimative), non la posizione precisa. Il modulo contiene anche un campo nascosto che serve solo a bloccare gli invii automatici (spam) e non raccoglie dati dell'utente.

Se l'indirizzo e-mail è già presente nella lista contatti di SIMCA, Mailchimp non accetta un nuovo invio e il sito invita l'utente a scrivere a info@simca-srl.com.

I dati di chi non seleziona la casella facoltativa sono conservati nella lista contatti solo per gestire la richiesta di preventivo e sono esclusi da qualsiasi invio di newsletter o di comunicazioni commerciali.

Ogni richiesta inviata con il modulo viene notificata via e-mail al personale SIMCA incaricato di gestirla. Entro 4 giorni lavorativi dall'invio, SIMCA invia inoltre al richiedente, tramite Mailchimp, un'e-mail automatica di riscontro sulla richiesta. Questa e-mail riguarda solo la richiesta, non contiene comunicazioni commerciali e viene inviata anche a chi non ha selezionato la casella facoltativa; in questa e-mail la misurazione di aperture e clic è disattivata.

Basi giuridiche e tempi di conservazione sono indicati nelle sezioni «Finalità e basi giuridiche» e «Periodi di conservazione».

Misurazione di aperture e clic nelle e-mail

Le e-mail inviate tramite Mailchimp possono contenere un'immagine invisibile (pixel) e link tracciati, che permettono di sapere se e quando un'e-mail è stata aperta e quali link sono stati cliccati, insieme a dati tecnici come l'indirizzo IP e il tipo di dispositivo. Questa misurazione riguarda solo le e-mail inviate a chi ha prestato il consenso alla newsletter o alle comunicazioni commerciali e rientra in quel consenso. SIMCA utilizza queste informazioni per valutare l'efficacia delle comunicazioni e migliorarne i contenuti. L'utente può impedirla disattivando il caricamento automatico delle immagini nel proprio programma di posta oppure revocando il consenso.

Per recapitare le e-mail, Mailchimp registra i dati necessari all'invio, come l'avvenuta consegna, gli errori di recapito e le disiscrizioni. SIMCA li utilizza solo per gestire la lista contatti, ad esempio per non scrivere più a indirizzi non validi o a chi ha annullato l'iscrizione.

SIMCA non utilizza gli indicatori che Mailchimp calcola sui singoli contatti, come la localizzazione approssimativa o il punteggio di attività, per profilare i destinatari o per scegliere quali contenuti inviare a ciascuno.

Contatti via e-mail o telefono

Se l'utente scrive a uno degli indirizzi e-mail indicati sul sito, come info@simca-srl.com o sales@simca-srl.com, o chiama uno dei numeri di telefono indicati sul sito, come il +39 030 731762 (anche tramite i link presenti nelle pagine), SIMCA tratta i dati che l'utente stesso comunica (ad esempio nome, azienda, recapiti, contenuto della richiesta e allegati) per rispondere alla richiesta e, se ne nasce un rapporto commerciale, per le finalità indicate nella sezione «Finalità e basi giuridiche». Questi dati non vengono inseriti in liste per l'invio di comunicazioni commerciali senza il consenso dell'utente.

Se l'utente invia spontaneamente il proprio curriculum, SIMCA lo utilizza solo per valutare un possibile rapporto di lavoro o di collaborazione e fornisce le informazioni specifiche sul trattamento al primo contatto utile, come previsto dall'art. 111-bis del Codice. Per questo trattamento non è richiesto il consenso. SIMCA invita a non inserire nel curriculum dati non necessari, in particolare dati relativi alla salute.

Se il curriculum contiene categorie particolari di dati (ad esempio l'appartenenza a categorie protette), SIMCA li tratta solo se necessari per valutare la candidatura, nei limiti dell'art. 9, par. 2, lett. b, GDPR; in caso contrario non li utilizza.

Basi giuridiche e tempi di conservazione sono indicati nelle sezioni «Finalità e basi giuridiche» e «Periodi di conservazione».

Finalità e basi giuridiche

SIMCA tratta i dati solo per le finalità indicate di seguito. Per ciascuna finalità è indicata la base giuridica prevista dall'art. 6 GDPR.

  • Funzionamento e sicurezza del sito (dati di navigazione e cookie tecnico). Base giuridica: legittimo interesse di SIMCA a rendere disponibile il sito, a garantirne la sicurezza e a prevenire abusi (art. 6, par. 1, lett. f, GDPR).
  • Risposta alle richieste di un utente che agisce per conto proprio (ad esempio professionista o imprenditore individuale), tramite il modulo di richiesta di preventivo, l'e-mail o il telefono. Base giuridica: misure precontrattuali adottate su richiesta dell'utente (art. 6, par. 1, lett. b, GDPR).
  • Risposta alle richieste di un utente che agisce per conto di un'azienda, tramite il modulo di richiesta di preventivo, l'e-mail o il telefono. Base giuridica: legittimo interesse di SIMCA a rispondere ai referenti di imprese clienti o potenziali clienti (art. 6, par. 1, lett. f, GDPR).
  • Gestione del rapporto contrattuale, se alla richiesta segue un contratto. Base giuridica: esecuzione del contratto (art. 6, par. 1, lett. b, GDPR) quando l'utente è parte del contratto; legittimo interesse di SIMCA a gestire i rapporti con i referenti dell'azienda cliente (art. 6, par. 1, lett. f, GDPR) negli altri casi.
  • Valutazione dei curriculum inviati spontaneamente. Base giuridica: misure precontrattuali adottate su richiesta dell'utente (art. 6, par. 1, lett. b, GDPR e art. 111-bis del Codice).
  • Invio della newsletter a chi si iscrive con il modulo in fondo alle pagine e invio di comunicazioni commerciali e aggiornamenti via e-mail a chi seleziona la casella facoltativa del modulo di richiesta di preventivo. Ciascun consenso vale solo per le comunicazioni per cui è stato espresso. Base giuridica: consenso dell'utente (art. 6, par. 1, lett. a, GDPR e art. 130 del Codice). Il consenso è necessario anche per gli indirizzi e-mail aziendali.
  • Adempimento di obblighi di legge, ad esempio obblighi contabili e fiscali se alla richiesta segue un contratto, conservazione della prova del consenso e della revoca, anche per evitare nuovi invii a chi ha revocato il consenso (artt. 7 e 21 GDPR), e risposta alle richieste delle autorità. Base giuridica: obbligo legale (art. 6, par. 1, lett. c, GDPR).
  • Tutela dei diritti di SIMCA, anche in sede giudiziaria. Base giuridica: legittimo interesse di SIMCA ad accertare, esercitare o difendere un diritto (art. 6, par. 1, lett. f, GDPR).

Per rispondere alle richieste non è richiesto il consenso.

Quando il trattamento si basa sul legittimo interesse, l'utente può chiedere informazioni sulla valutazione con cui SIMCA ha bilanciato il proprio interesse con i diritti e le libertà dell'utente, scrivendo a info@simca-srl.com.

Se SIMCA intende utilizzare i dati per una finalità diversa da quelle indicate, informa prima l'utente.

Dati obbligatori e facoltativi

L'utente non è obbligato per legge o per contratto a fornire dati personali a SIMCA. Alcuni dati sono però necessari per ottenere ciò che chiede:

  • Dati di navigazione: sono trasmessi automaticamente dal browser e sono indispensabili per visualizzare il sito.
  • Newsletter: l'indirizzo e-mail è necessario per iscriversi.
  • Richiesta di preventivo: nome, cognome, azienda ed e-mail sono necessari per identificare il richiedente e rispondere; senza questi dati il modulo non può essere inviato. Il telefono è facoltativo. La casella «Ho letto l'informativa privacy» è necessaria per inviare il modulo. Il consenso alle comunicazioni commerciali è facoltativo: se l'utente non lo presta, SIMCA risponde comunque alla richiesta.
  • Contatti via e-mail o telefono: l'utente decide quali dati comunicare. Senza un recapito, SIMCA non può rispondere.

Destinatari dei dati

I dati sono trattati dal personale di SIMCA autorizzato e istruito (art. 29 GDPR e art. 2-quaterdecies del Codice), solo nella misura necessaria ai loro compiti. Per conto di SIMCA trattano i dati anche i seguenti fornitori, che agiscono come responsabili del trattamento (art. 28 GDPR) in base ai rispettivi accordi sul trattamento dei dati:

  • Webflow, Inc., 398 11th Street, 2nd Floor, San Francisco, CA 94103, USA: hosting del sito, distribuzione dei contenuti, sicurezza e gestione del modulo newsletter, comprese le notifiche dei moduli. Webflow si avvale a sua volta di sub-responsabili, tra cui Amazon Web Services, Inc. (infrastruttura cloud e archiviazione, compresi Amazon S3 e Amazon CloudFront) e Cloudflare, Inc. (rete di distribuzione dei contenuti e protezione da attacchi), entrambi con sede negli Stati Uniti. Per i trattamenti per finalità proprie descritti nella sezione «Dati di navigazione» (misurazione del traffico, sicurezza della piattaforma, analisi su dati de-identificati), Webflow agisce come titolare autonomo, secondo la propria informativa. Documenti: accordo sul trattamento dei dati, elenco dei sub-responsabili, informativa sulla privacy di Webflow.
  • The Rocket Science Group LLC d/b/a Mailchimp (gruppo Intuit), 405 North Angier Ave. NE, Atlanta, GA 30308, USA: gestione del modulo di richiesta di preventivo, della lista contatti (compresi gli iscritti alla newsletter) e dell'invio delle e-mail. Documenti: accordo sul trattamento dei dati, elenco dei sub-responsabili, informativa sulla privacy di Mailchimp (Intuit Global Privacy Statement). Per alcuni trattamenti propri, come la sicurezza dei servizi e la prevenzione delle frodi, Mailchimp agisce come titolare autonomo: questi trattamenti sono descritti nella stessa informativa.
  • Il fornitore del servizio di posta elettronica aziendale di SIMCA, per i messaggi ricevuti agli indirizzi e-mail di SIMCA e per le notifiche dei moduli.
  • I fornitori incaricati da SIMCA della realizzazione e della manutenzione tecnica del sito, che accedono all'archivio dei moduli di Webflow solo per finalità di assistenza tecnica.

SIMCA comunica i dati alle autorità pubbliche e giudiziarie quando lo richiede la legge e ai professionisti che la assistono (ad esempio consulenti legali o fiscali) quando ciò è necessario per le finalità indicate sopra.

SIMCA non vende i dati personali, non li cede a terzi per loro finalità di marketing e non li diffonde.

Trasferimento dei dati fuori dallo Spazio economico europeo (SEE)

Webflow e Mailchimp hanno sede negli Stati Uniti e trattano i dati su server situati negli Stati Uniti. Webflow utilizza anche la rete globale di distribuzione dei contenuti di Cloudflare. Mailchimp e i suoi sub-responsabili possono trattare i dati anche negli altri paesi indicati nell'elenco dei sub-responsabili di Mailchimp; per Webflow i paesi sono indicati nell'elenco dei sub-responsabili di Webflow. I dati sono quindi trasferiti fuori dallo Spazio economico europeo (SEE), in particolare negli Stati Uniti, con le seguenti garanzie:

  • Decisione di adeguatezza. Webflow, Inc. e The Rocket Science Group LLC d/b/a Mailchimp (tramite la certificazione di Intuit Inc.) sono iscritte all'elenco del Data Privacy Framework UE-USA. Per le organizzazioni iscritte a questo elenco, la Commissione europea ha riconosciuto un livello di protezione adeguato con la decisione di esecuzione (UE) 2023/1795 del 10 luglio 2023 (art. 45 GDPR). L'iscrizione è verificabile nell'elenco ufficiale del Data Privacy Framework.
  • Clausole contrattuali tipo. Se il Data Privacy Framework non si applica o viene meno, gli accordi sul trattamento dei dati di Webflow e di Mailchimp prevedono l'applicazione delle clausole contrattuali tipo approvate dalla Commissione europea con la decisione di esecuzione (UE) 2021/914 del 4 giugno 2021 (art. 46, par. 2, lett. c, GDPR).
  • Sub-responsabili. Webflow e Mailchimp trasmettono i dati ai propri sub-responsabili, come Amazon Web Services e Cloudflare, solo con obblighi di protezione equivalenti, come previsto dai rispettivi accordi sul trattamento dei dati e dai principi del Data Privacy Framework sui trasferimenti successivi.
  • Altri fornitori. Se altri fornitori indicati nella sezione «Destinatari dei dati» trattano i dati fuori dal SEE, il trasferimento avviene solo verso paesi coperti da una decisione di adeguatezza della Commissione europea o sulla base delle clausole contrattuali tipo (art. 46, par. 2, lett. c, GDPR). L'utente può chiedere i nomi di questi fornitori, i paesi interessati e una copia delle garanzie scrivendo a info@simca-srl.com.

L'utente può ottenere una copia delle garanzie adottate scrivendo a info@simca-srl.com oppure consultando gli accordi sul trattamento dei dati di Webflow e di Mailchimp.

Periodi di conservazione

SIMCA conserva i dati solo per il tempo necessario alle finalità per cui sono raccolti, secondo questi criteri:

  • Dati di navigazione: SIMCA non ha accesso diretto ai registri tecnici del server e non ne conserva copie. Webflow non indica un periodo fisso di conservazione: per i trattamenti svolti per conto di SIMCA, i registri sono conservati al massimo per la durata del contratto tra SIMCA e Webflow e poi cancellati, come previsto dall'accordo sul trattamento dei dati di Webflow; per gli usi propri di Webflow vale la sua informativa. Se SIMCA ottiene questi dati per accertare un abuso o un reato informatico, li conserva per il tempo necessario all'accertamento e all'eventuale procedimento e li cancella alla sua conclusione.
  • Cookie tecnico _cfuvid: viene cancellato alla chiusura del browser.
  • Richieste di preventivo e contatti via e-mail o telefono che non portano a un contratto: 24 mesi dall'ultimo contatto. Trascorso questo periodo, i dati vengono cancellati in modo definitivo, anche dalla lista contatti su Mailchimp se l'utente non ha prestato il consenso alle comunicazioni commerciali.
  • Dati relativi a un contratto concluso con SIMCA, compresa la corrispondenza commerciale: 10 anni dalla data dell'ultima registrazione contabile relativa al contratto, come previsto dall'art. 2220 del Codice civile.
  • Newsletter e comunicazioni commerciali: fino alla revoca del consenso, anche tramite il link di disiscrizione.
  • Iscrizioni alla newsletter nell'archivio dei moduli di Webflow: per il tempo necessario a gestire l'iscrizione e comunque non oltre la revoca del consenso.
  • Notifiche e-mail dei moduli ricevute da SIMCA: per lo stesso periodo previsto per l'iscrizione corrispondente.
  • Prova del consenso e della revoca: dopo la revoca, SIMCA conserva solo l'indirizzo e-mail, le date del consenso e della revoca e il modulo con cui il consenso è stato espresso, per non inviare altre comunicazioni e per poter dimostrare la correttezza del trattamento, per 5 anni dalla revoca.
  • Curriculum inviati spontaneamente: 12 mesi dalla ricezione, salvo l'avvio di un rapporto di lavoro o di collaborazione.
  • Dati necessari alla tutela dei diritti di SIMCA: in caso di contestazione, per tutta la durata del procedimento e fino alla scadenza dei termini di impugnazione.

Alla scadenza dei periodi indicati, i dati vengono cancellati o resi anonimi.

Diritti dell'utente

L'utente ha i seguenti diritti sui propri dati personali e può esercitarli in qualsiasi momento:

  • Accesso (art. 15 GDPR): sapere se SIMCA tratta dati che lo riguardano e ottenerne una copia, insieme alle informazioni sul trattamento.
  • Rettifica (art. 16 GDPR): correggere i dati inesatti o completare quelli incompleti.
  • Cancellazione (art. 17 GDPR): ottenere la cancellazione dei dati, ad esempio quando non sono più necessari o quando l'utente revoca il consenso, salvo che SIMCA debba conservarli per obbligo di legge o per tutelare un proprio diritto.
  • Limitazione (art. 18 GDPR): chiedere che i dati siano soltanto conservati e non utilizzati, ad esempio mentre SIMCA verifica una richiesta di rettifica o di opposizione.
  • Portabilità (art. 20 GDPR): ricevere i dati forniti a SIMCA in un formato strutturato, di uso comune e leggibile da computer, e chiederne l'invio a un altro titolare. Il diritto vale per i dati trattati con mezzi automatizzati sulla base del consenso o di misure precontrattuali.
  • Opposizione (art. 21 GDPR): opporsi al trattamento, come spiegato nella sezione «Diritto di opposizione».
  • Decisioni automatizzate (art. 22 GDPR): non essere sottoposto a decisioni prese solo da un sistema automatizzato, compresa la profilazione, che abbiano effetti giuridici o effetti altrettanto importanti per l'utente. SIMCA non prende decisioni di questo tipo.
  • Revoca del consenso (art. 7, par. 3, GDPR): vedi la sezione «Revoca del consenso».
  • Reclamo (art. 77 GDPR): vedi la sezione «Reclamo al Garante».

Come esercitare i diritti. L'utente può inviare la richiesta a info@simca-srl.com oppure per posta a SIMCA S.R.L., Via Roma, 58, 24067 Sarnico (BG). La richiesta è gratuita. SIMCA risponde entro un mese dal ricevimento. Se la richiesta è complessa o le richieste sono numerose, il termine può essere prorogato di due mesi: in questo caso SIMCA ne informa l'utente entro il primo mese. Se SIMCA ha dubbi ragionevoli sull'identità di chi presenta la richiesta, può chiedere le informazioni necessarie a confermarla.

Anche per i dati gestiti da Webflow e da Mailchimp per conto di SIMCA, l'utente si rivolge a SIMCA, che si coordina con i fornitori. Per i trattamenti che Webflow e Mailchimp svolgono come titolari autonomi, l'utente può rivolgersi anche direttamente a loro, ai recapiti indicati nelle rispettive informative. SIMCA comunica le rettifiche, le cancellazioni e le limitazioni ai destinatari dei dati, salvo che ciò risulti impossibile o richieda uno sforzo sproporzionato (art. 19 GDPR).

Diritto di opposizione

L'utente ha il diritto di opporsi in qualsiasi momento, per motivi connessi alla propria situazione particolare, ai trattamenti basati sul legittimo interesse di SIMCA (art. 21, par. 1, GDPR), come la gestione della sicurezza del sito o la risposta alle richieste inviate per conto di un'azienda. In questo caso SIMCA smette di trattare i dati, a meno che non dimostri di avere motivi legittimi impellenti che prevalgono sugli interessi, sui diritti e sulle libertà dell'utente, oppure che i dati le servano per accertare, esercitare o difendere un diritto in sede giudiziaria.

L'utente ha inoltre il diritto di opporsi in qualsiasi momento, senza indicare alcun motivo, al trattamento dei propri dati per finalità di marketing diretto (art. 21, par. 2 e 3, GDPR). Dopo l'opposizione SIMCA non invia più comunicazioni commerciali all'utente.

Per opporsi è sufficiente scrivere a info@simca-srl.com oppure, per le comunicazioni commerciali, usare il link di disiscrizione presente in fondo a ogni e-mail.

Revoca del consenso

L'utente può revocare in qualsiasi momento il consenso a ricevere la newsletter e le comunicazioni commerciali, con la stessa facilità con cui lo ha prestato: cliccando sul link di disiscrizione presente in fondo a ogni e-mail oppure scrivendo a info@simca-srl.com. La revoca vale per il futuro: non rende illecito il trattamento svolto prima e non ha alcuna conseguenza sulle richieste di preventivo o sugli altri rapporti con SIMCA.

Reclamo al Garante

Se ritiene che il trattamento dei propri dati violi la normativa in materia di protezione dei dati personali, l'utente ha il diritto di proporre reclamo all'autorità di controllo dello Stato membro in cui risiede abitualmente, lavora o in cui si è verificata la presunta violazione (art. 77 GDPR). In Italia l'autorità di controllo è il Garante per la protezione dei dati personali:

L'utente può inoltre rivolgersi al giudice (art. 79 GDPR). Il reclamo al Garante e l'azione davanti al giudice sono alternativi (art. 140-bis del Codice): se l'utente si è già rivolto al giudice, non può presentare reclamo al Garante per la stessa questione e nei confronti dello stesso titolare; se ha presentato reclamo al Garante, non può poi rivolgersi al giudice per la stessa questione e nei confronti dello stesso titolare, salvo quanto previsto dall'art. 10, comma 4, del D.Lgs. 1° settembre 2011, n. 150.

Minori

Il sito e i servizi di SIMCA sono rivolti a imprese e professionisti, non ai minori di 18 anni. SIMCA non raccoglie consapevolmente dati di minori e chiede loro di non inviare dati tramite i moduli del sito. Se SIMCA scopre di aver ricevuto dati di un minore, li cancella senza ritardo.

Sicurezza dei dati

Privacy Policy

This is the English translation of the Italian privacy policy (“Informativa sulla privacy”). In the event of any discrepancy between the two versions, the Italian version prevails.

This privacy policy explains how SIMCA S.R.L. processes the personal data of people who visit the website and of people who contact SIMCA through the website or using the contact details shown on the website. The information is provided under Art. 13 of Regulation (EU) 2016/679 (GDPR) and Legislative Decree no. 196 of 30 June 2003 (Personal Data Protection Code), as amended by Legislative Decree no. 101 of 10 August 2018 (the “Code”).

This policy applies to the website www.simca-srl.com, including when it is reached from simca-srl.com. It does not cover third-party websites that can be reached through links.

“User” means the natural person to whom the data relate: anyone who visits the website, fills in a form or contacts SIMCA. The website is mainly aimed at businesses and professionals. The data of company contact persons (for example name, work email address and phone number) are also personal data and are processed as described below.

This policy is available in Italian and in English, and the two versions have the same content. In the event of differences due to translation, the Italian version prevails; for any questions, users can write to info@simca-srl.com.

Browsing data

The website is built and hosted on the Webflow platform. To display the pages, the systems of Webflow and of its infrastructure providers (Amazon Web Services and Cloudflare) automatically receive and record the technical data that the browser transmits on every visit, including:

  • the IP address of the device
  • the date and time of the request
  • the page or file requested
  • the browser type and operating system (user agent)
  • the browser language and other information contained in the HTTP headers of the request

While users browse, the pages load files (images, style sheets, scripts and fonts) only from the servers of Webflow and its providers: cdn.prod.website-files.com, s3.amazonaws.com (Amazon S3) and d3e54v103j8qbb.cloudfront.net (Amazon CloudFront). The website does not load content from other services: it contains no maps, embedded videos, social network buttons, advertising pixels or analytics tools. The connections made when forms are submitted are described in the dedicated sections.

On SIMCA's behalf, these data are processed only to operate the website and protect it from attacks and abuse, and are not used to identify or profile users. SIMCA has no direct access to these logs. Only in the event of an attack or computer crime against the website may SIMCA request them from Webflow, in order to establish responsibility or to hand them over to the competent authorities that request them.

Webflow also uses the technical data of visitors to the websites it hosts for its own purposes, as stated in its privacy policy: measuring the traffic volume of websites (including for billing purposes), protecting its own platform, carrying out statistical analysis and developing analytics products based on de-identified data. For this processing, Webflow acts as an independent controller.

Cookies and similar technologies

Cookies are small text files that a website stores in the user's browser. In this policy, cookies and similar tools are considered technical if they are used only to transmit a communication or are strictly necessary to provide a service requested by the user (Art. 122(1) of the Code). Other cookies, such as analytics, profiling or advertising cookies, generally require the user's consent.

While users browse, the website sets only one cookie, which is a technical cookie: _cfuvid. It is set by Cloudflare, Webflow's provider for delivering and protecting the website, on www.simca-srl.com and on the addresses that redirect to the website. It is used to distinguish individual visitors who share the same IP address, so that security systems can limit anomalous requests without blocking other users. It is a session cookie: it is deleted when the browser is closed. Page scripts cannot read it and it is not used to track users. More information is available in the Cloudflare documentation.

SIMCA does not use analytics, profiling or advertising cookies, whether its own or third-party, or other tracking techniques such as fingerprinting. While users browse, the website does not store data in the browser's local storage (localStorage or sessionStorage).

Since only one technical cookie is present while users browse, the website does not ask for consent and does not display a cookie banner, as permitted by the Italian Data Protection Authority's Guidelines on cookies and other tracking tools of 10 June 2021.

Third-party services contacted when forms are submitted. When the user submits the quote request form, the browser sends the data directly to Mailchimp's servers (simca-srl.us22.list-manage.com). On this occasion, Mailchimp and Akamai, its security provider, may set the following third-party cookies:

  • _abck (Akamai): used to recognise and block automated traffic. Duration: 1 year.
  • bm_sz (Akamai): used to recognise and block automated traffic. Duration: about 4 hours.
  • _mcid (Mailchimp): an identifier set by Mailchimp, whose purpose Mailchimp does not publish. SIMCA does not use it. Duration: 1 year.

Whether and which of these cookies are stored depends on the browser: many browsers block third-party cookies by default. When the user submits the newsletter form, the browser sends the data to Webflow's servers (webflow.com). SIMCA does not read or use the cookies of these services. More information: Mailchimp cookie policy and Webflow cookie policy.

Managing cookies in the browser. Users can delete cookies and block them from being installed through their browser settings.

Cookie preferences. From the “Cookie Settings” link at the bottom of every page, users can check at any time the categories of cookies used by the website. Today only technical cookies are used, which do not require consent. If optional cookies are added in the future, users will be able to give, refuse or withdraw consent from the same link; their choice will be stored for 6 months in a technical cookie (simca_consent) and, until consent is given, optional services will remain blocked.

Before adding non-technical tools to the website, such as visitor statistics, maps or embedded videos, SIMCA will update this policy and ask for the user's consent through a banner.

Newsletter subscription

At the bottom of every page there is the “Subscribe to newsletter” form, which asks only for an email address. The form is managed by Webflow. When the user submits it, the browser transmits the email address to Webflow's servers together with the following technical data: IP address, browser type, the page from which the form was submitted, date and time. Webflow records the subscription in the website's form archive, which SIMCA has access to, and sends a notification with the form data to a SIMCA email inbox.

SIMCA uses the address solely to send its newsletter, with updates on the company's products, services, news and initiatives. To manage the subscriber list and send the newsletter, SIMCA may add the address to its contact list on Mailchimp (see “Recipients of the data”).

The subscription is based on the user's consent, given by submitting the form after reading the note below the email field, which states the purpose of the subscription and refers to this policy. Users can unsubscribe at any time using the link at the bottom of every email or by writing to info@simca-srl.com.

Newsletter emails may measure opens and clicks, as explained in the section “Measurement of email opens and clicks”. Legal bases and retention periods are set out in the sections “Purposes and legal bases” and “Retention periods”.

Quote request

The page dedicated to SIMCA STARLIGHT water recycling systems (www.simca-srl.com/green) contains the form “Richiedi il test gratuito” (“Request the free test”), through which the user can request the free STARLIGHT test or a quote (in this policy, for brevity, “quote request”). The form collects the following data:

  • First name (mandatory)
  • Surname (mandatory)
  • Company, i.e. the registered company name (mandatory)
  • Email (mandatory)
  • Phone (optional)

The form also contains two checkboxes:

  • “Ho letto l'informativa privacy” (“I have read the privacy policy”) (mandatory): it only confirms that the user has been able to read this policy. It is not consent and it is not transmitted to Mailchimp.
  • “Acconsento a ricevere via email comunicazioni commerciali e aggiornamenti da SIMCA” (“I agree to receive marketing communications and updates from SIMCA by email”) (optional and not pre-ticked): this is the consent to receive marketing communications and updates by email. If the user does not tick it, SIMCA still replies to the quote request.

SIMCA uses these data to reply to the quote request and, only if the user has ticked the optional box, to send them marketing communications and updates by email.

The form is connected to Mailchimp, the platform SIMCA uses to organise contacts and send emails. When the user submits the form, the browser transmits the data directly to Mailchimp's servers (simca-srl.us22.list-manage.com), without passing through Webflow. Together with the form data, Mailchimp records in SIMCA's contact list:

  • the choice made on the marketing consent checkbox
  • an internal label (tag), the same for all requests submitted through this form
  • the technical data of the submission: IP address, date and time

From the IP address, Mailchimp derives an approximate location (country, region, time zone and approximate coordinates), not the precise position. The form also contains a hidden field that is used only to block automated submissions (spam) and does not collect any user data.

If the email address is already in SIMCA's contact list, Mailchimp does not accept a new submission and the website invites the user to write to info@simca-srl.com.

The data of users who do not tick the optional box are kept in the contact list only to handle the quote request and are excluded from any sending of newsletters or marketing communications.

Each request submitted through the form is notified by email to the SIMCA staff responsible for handling it. Within 4 working days of submission, SIMCA also sends the requester, through Mailchimp, an automatic email acknowledging the request. This email concerns only the request, contains no marketing communications and is also sent to users who have not ticked the optional box; open and click measurement is disabled in this email.

Legal bases and retention periods are set out in the sections “Purposes and legal bases” and “Retention periods”.

Measurement of email opens and clicks

Emails sent through Mailchimp may contain an invisible image (pixel) and tracked links that show whether and when an email was opened and which links were clicked, together with technical data such as IP address and device type. This measurement only concerns emails sent to people who have consented to the newsletter or to marketing communications and is covered by that consent. SIMCA uses this information to assess the effectiveness of its communications and to improve their content. Users can prevent it by disabling automatic image loading in their email program or by withdrawing consent.

To deliver emails, Mailchimp records the data needed for sending, such as successful delivery, delivery errors and unsubscribes. SIMCA uses them only to manage the contact list, for example to stop writing to invalid addresses or to people who have unsubscribed.

SIMCA does not use the indicators that Mailchimp calculates for individual contacts, such as approximate location or activity score, to profile recipients or to choose which content to send to each of them.

Contact by email or phone

If the user writes to one of the email addresses shown on the website, such as info@simca-srl.com or sales@simca-srl.com, or calls one of the phone numbers shown on the website, such as +39 030 731762 (including through the links on the pages), SIMCA processes the data that the user provides (for example name, company, contact details, content of the request and attachments) to reply to the request and, if a business relationship results, for the purposes set out in the section “Purposes and legal bases”. These data are not added to lists for sending marketing communications without the user's consent.

If the user sends their CV on their own initiative, SIMCA uses it only to assess a possible employment or collaboration relationship and provides specific information on the processing at the first appropriate contact, as provided for by Art. 111-bis of the Code. Consent is not required for this processing. SIMCA asks users not to include unnecessary data in their CV, in particular health data.

If the CV contains special categories of data (for example belonging to protected categories of workers), SIMCA processes them only if necessary to assess the application, within the limits of Art. 9(2)(b) GDPR; otherwise it does not use them.

Legal bases and retention periods are set out in the sections “Purposes and legal bases” and “Retention periods”.

Purposes and legal bases

SIMCA processes data only for the purposes set out below. For each purpose, the legal basis under Art. 6 GDPR is indicated.

  • Operation and security of the website (browsing data and technical cookie). Legal basis: SIMCA's legitimate interest in making the website available, ensuring its security and preventing abuse (Art. 6(1)(f) GDPR).
  • Replying to requests from a user acting on their own behalf (for example a professional or sole trader), through the quote request form, email or phone. Legal basis: pre-contractual measures taken at the user's request (Art. 6(1)(b) GDPR).
  • Replying to requests from a user acting on behalf of a company, through the quote request form, email or phone. Legal basis: SIMCA's legitimate interest in replying to contact persons of client or prospective client businesses (Art. 6(1)(f) GDPR).
  • Management of the contractual relationship, if the request is followed by a contract. Legal basis: performance of the contract (Art. 6(1)(b) GDPR) when the user is a party to the contract; SIMCA's legitimate interest in managing relationships with the contact persons of the client company (Art. 6(1)(f) GDPR) in other cases.
  • Assessment of CVs sent on the sender's own initiative. Legal basis: pre-contractual measures taken at the user's request (Art. 6(1)(b) GDPR and Art. 111-bis of the Code).
  • Sending the newsletter to those who subscribe using the form at the bottom of the pages and sending marketing communications and updates by email to those who tick the optional box in the quote request form. Each consent applies only to the communications for which it was given. Legal basis: the user's consent (Art. 6(1)(a) GDPR and Art. 130 of the Code). Consent is also required for business email addresses.
  • Compliance with legal obligations, for example accounting and tax obligations if the request is followed by a contract, keeping proof of consent and of its withdrawal, including to avoid sending further communications to those who have withdrawn consent (Arts. 7 and 21 GDPR), and responding to requests from authorities. Legal basis: legal obligation (Art. 6(1)(c) GDPR).
  • Protection of SIMCA's rights, including in court. Legal basis: SIMCA's legitimate interest in establishing, exercising or defending a right (Art. 6(1)(f) GDPR).

Consent is not required to reply to requests.

Where processing is based on legitimate interest, users can request information on the assessment by which SIMCA balanced its interest against the user's rights and freedoms, by writing to info@simca-srl.com.

If SIMCA intends to use the data for a purpose other than those indicated, it informs the user beforehand.

Mandatory and optional data

Users are not obliged by law or by contract to provide personal data to SIMCA. However, some data are necessary to obtain what they request:

  • Browsing data: these are transmitted automatically by the browser and are essential to display the website.
  • Newsletter: the email address is necessary to subscribe.
  • Quote request: first name, surname, company and email address are necessary to identify the requester and reply; without these data the form cannot be submitted. The phone number is optional. The “Ho letto l'informativa privacy” (“I have read the privacy policy”) box is necessary to submit the form. Consent to marketing communications is optional: if the user does not give it, SIMCA still replies to the request.
  • Contact by email or phone: the user decides which data to provide. Without contact details, SIMCA cannot reply.

Recipients of the data

The data are processed by SIMCA staff who are authorised and instructed (Art. 29 GDPR and Art. 2-quaterdecies of the Code), only to the extent necessary for their tasks. The following providers also process the data on SIMCA's behalf, acting as data processors (Art. 28 GDPR) under their respective data processing agreements:

  • Webflow, Inc., 398 11th Street, 2nd Floor, San Francisco, CA 94103, USA: website hosting, content delivery, security and management of the newsletter form, including form notifications. Webflow in turn uses sub-processors, including Amazon Web Services, Inc. (cloud infrastructure and storage, including Amazon S3 and Amazon CloudFront) and Cloudflare, Inc. (content delivery network and protection against attacks), both based in the United States. For the processing for its own purposes described in the section “Browsing data” (traffic measurement, platform security, analysis of de-identified data), Webflow acts as an independent controller, in accordance with its own privacy policy.   • The Rocket Science Group LLC d/b/a Mailchimp (Intuit group), 405 North Angier Ave. NE, Atlanta, GA 30308, USA: management of the quote request form, the contact list (including newsletter subscribers) and the sending of emails. Documents: data processing agreement, list of sub-processors, Mailchimp privacy policy (Intuit Global Privacy Statement). For some processing for its own purposes, such as service security and fraud prevention, Mailchimp acts as an independent controller: this processing is described in the same privacy policy.
  • SIMCA's business email service provider, for messages received at SIMCA's email addresses and for form notifications.
  • The providers engaged by SIMCA to build and technically maintain the website, who access Webflow's form archive only for technical support purposes.

SIMCA discloses data to public and judicial authorities when required by law and to the professionals who assist it (for example legal or tax advisers) when this is necessary for the purposes set out above.

SIMCA does not sell personal data, does not pass them on to third parties for their own marketing purposes and does not disseminate them.

Transfers of data outside the European Economic Area (EEA)

Webflow and Mailchimp are based in the United States and process data on servers located in the United States. Webflow also uses Cloudflare's global content delivery network. Mailchimp and its sub-processors may also process data in the other countries listed in Mailchimp's list of sub-processors; for Webflow, the countries are listed in Webflow's list of sub-processors. Data are therefore transferred outside the European Economic Area (EEA), in particular to the United States, with the following safeguards:

  • Adequacy decision. Webflow, Inc. and The Rocket Science Group LLC d/b/a Mailchimp (through the certification of Intuit Inc.) are included in the EU-U.S. Data Privacy Framework list. For organisations on this list, the European Commission has recognised an adequate level of protection by Implementing Decision (EU) 2023/1795 of 10 July 2023 (Art. 45 GDPR). Their inclusion can be verified in the official Data Privacy Framework list.
  • Standard contractual clauses. If the Data Privacy Framework does not apply or ceases to apply, the data processing agreements of Webflow and Mailchimp provide for the application of the standard contractual clauses approved by the European Commission by Implementing Decision (EU) 2021/914 of 4 June 2021 (Art. 46(2)(c) GDPR).
  • Sub-processors. Webflow and Mailchimp transfer data to their sub-processors, such as Amazon Web Services and Cloudflare, only subject to equivalent protection obligations, as provided for in their respective data processing agreements and in the Data Privacy Framework principles on onward transfers.
  • Other providers. If other providers listed in the section “Recipients of the data” process data outside the EEA, the transfer takes place only to countries covered by a European Commission adequacy decision or on the basis of standard contractual clauses (Art. 46(2)(c) GDPR). Users can request the names of these providers, the countries concerned and a copy of the safeguards by writing to info@simca-srl.com.

Users can obtain a copy of the safeguards adopted by writing to info@simca-srl.com or by consulting the data processing agreements of Webflow and Mailchimp.

Retention periods

SIMCA keeps data only for as long as necessary for the purposes for which they are collected, according to the following criteria:

  • Browsing data: SIMCA has no direct access to the server's technical logs and does not keep copies of them. Webflow does not specify a fixed retention period: for processing carried out on SIMCA's behalf, logs are kept at most for the duration of the contract between SIMCA and Webflow and then deleted, as provided for in Webflow's data processing agreement; for Webflow's own uses, its privacy policy applies. If SIMCA obtains these data to investigate abuse or a computer crime, it keeps them for as long as necessary for the investigation and any proceedings, and deletes them when these are concluded.
  • _cfuvid technical cookie: deleted when the browser is closed.
  • Quote requests and contacts by email or phone that do not lead to a contract: 24 months from the last contact. After this period, the data are permanently deleted, including from the Mailchimp contact list if the user has not given consent to marketing communications.
  • Data relating to a contract concluded with SIMCA, including business correspondence: 10 years from the date of the last accounting entry relating to the contract, as provided for by Art. 2220 of the Italian Civil Code.
  • Newsletter and marketing communications: until consent is withdrawn, including through the unsubscribe link.
  • Newsletter subscriptions in Webflow's form archive: for as long as necessary to manage the subscription and in any case no longer than until consent is withdrawn.
  • Form email notifications received by SIMCA: for the same period as the corresponding subscription.
  • Proof of consent and withdrawal: after withdrawal, SIMCA keeps only the email address, the dates of consent and withdrawal and the form through which consent was given, in order not to send further communications and to be able to demonstrate that the processing was carried out properly, for 5 years from withdrawal.
  • CVs sent on the sender's own initiative: 12 months from receipt, unless an employment or collaboration relationship begins.
  • Data needed to protect SIMCA's rights: in the event of a dispute, for the entire duration of the proceedings and until the time limits for appeal have expired.

When the periods indicated expire, the data are deleted or anonymised.

User rights

Users have the following rights over their personal data and can exercise them at any time:

  • Access (Art. 15 GDPR): to know whether SIMCA processes data concerning them and to obtain a copy, together with information on the processing.
  • Rectification (Art. 16 GDPR): to correct inaccurate data or complete incomplete data.
  • Erasure (Art. 17 GDPR): to obtain the erasure of data, for example when they are no longer necessary or when the user withdraws consent, unless SIMCA must keep them because of a legal obligation or to protect one of its rights.
  • Restriction (Art. 18 GDPR): to request that the data only be stored and not used, for example while SIMCA verifies a request for rectification or an objection.
  • Portability (Art. 20 GDPR): to receive the data provided to SIMCA in a structured, commonly used and machine-readable format, and to request that they be sent to another controller. This right applies to data processed by automated means on the basis of consent or pre-contractual measures.
  • Objection (Art. 21 GDPR): to object to processing, as explained in the section “Right to object”.
  • Automated decisions (Art. 22 GDPR): not to be subject to decisions taken solely by an automated system, including profiling, which produce legal effects or similarly significant effects for the user. SIMCA does not take decisions of this kind.
  • Withdrawal of consent (Art. 7(3) GDPR): see the section “Withdrawal of consent”.
  • Complaint (Art. 77 GDPR): see the section “Complaint to the Data Protection Authority”.

How to exercise these rights. Users can send their request to info@simca-srl.com or by post to SIMCA S.R.L., Via Roma, 58, 24067 Sarnico (BG). The request is free of charge. SIMCA replies within one month of receipt. If the request is complex or there are many requests, this period may be extended by two months: in this case SIMCA informs the user within the first month. If SIMCA has reasonable doubts about the identity of the person making the request, it may ask for the information necessary to confirm it.

For data managed by Webflow and Mailchimp on SIMCA's behalf, too, users should contact SIMCA, which coordinates with the providers. For the processing that Webflow and Mailchimp carry out as independent controllers, users can also contact them directly, using the contact details given in their respective privacy policies. SIMCA communicates any rectification, erasure or restriction to the recipients of the data, unless this proves impossible or involves disproportionate effort (Art. 19 GDPR).

Right to object

Users have the right to object at any time, on grounds relating to their particular situation, to processing based on SIMCA's legitimate interest (Art. 21(1) GDPR), such as managing the security of the website or replying to requests sent on behalf of a company. In this case SIMCA stops processing the data, unless it demonstrates compelling legitimate grounds that override the user's interests, rights and freedoms, or that it needs the data to establish, exercise or defend a right in court.

Users also have the right to object at any time, without giving any reason, to the processing of their data for direct marketing purposes (Art. 21(2) and (3) GDPR). After an objection, SIMCA no longer sends marketing communications to the user.

To object, simply write to info@simca-srl.com or, for marketing communications, use the unsubscribe link at the bottom of every email.

Withdrawal of consent

Users can withdraw their consent to receive the newsletter and marketing communications at any time, as easily as they gave it: by clicking the unsubscribe link at the bottom of every email or by writing to info@simca-srl.com. Withdrawal applies to the future: it does not make the processing carried out before it unlawful and has no effect on quote requests or other dealings with SIMCA.

Complaint to the Data Protection Authority

If users believe that the processing of their data infringes data protection law, they have the right to lodge a complaint with the supervisory authority of the Member State in which they habitually reside, in which they work or in which the alleged infringement took place (Art. 77 GDPR). In Italy, the supervisory authority is the Garante per la protezione dei dati personali (Italian Data Protection Authority):

Users can also bring proceedings before a court (Art. 79 GDPR). A complaint to the Garante and court proceedings are alternatives (Art. 140-bis of the Code): if the user has already brought proceedings before a court, they cannot lodge a complaint with the Garante on the same matter and against the same controller; if they have lodged a complaint with the Garante, they cannot then bring proceedings before a court on the same matter and against the same controller, except as provided for by Art. 10(4) of Legislative Decree no. 150 of 1 September 2011.

Minors

SIMCA's website and services are aimed at businesses and professionals, not at people under 18. SIMCA does not knowingly collect data from minors and asks them not to submit data through the website's forms. If SIMCA discovers that it has received data from a minor, it deletes them without delay.

Links to third-party websites

The website contains the following links to third-party websites:

  • at the bottom of the pages, brandblock.studio, which designed the website
  • at the bottom of the pages, wavescreative.co, which developed the website
  • in the quote request form, Mailchimp's terms of use

By opening one of these links, the user leaves SIMCA's website: the destination website receives the technical data of the connection, such as IP address and browser type, and may know that the user came from SIMCA's website. SIMCA does not control these websites and is not responsible for the processing they carry out: it therefore invites users to read their respective privacy policies.

Data security

The website uses an encrypted connection (HTTPS) and the website's other addresses redirect to https://www.simca-srl.com. SIMCA's providers apply the security measures described in their respective data processing agreements: for example, Webflow states that it encrypts stored data, makes daily backups and holds SOC 2 Type II certification. Within SIMCA, access to data is limited to authorised staff. These measures serve to protect data against unauthorised access, loss or disclosure (Art. 32 GDPR).

Changes to this policy

SIMCA updates this policy when the processing described changes, for example if it adds new tools, new providers or new purposes to the website, or when changes in the law require it. The updated version is published on this page with a new version number and the new update date, shown at the top of the page.

In the event of significant changes, such as a new purpose, new recipients or new transfers outside the EEA, SIMCA publishes a notice on the website before the changes apply. It also informs by email the users whose address it holds and, where necessary, asks for new consent.
